    Type of Non-Immigrant Visa

    Type of NON-IMMIGRANT VISA

    1. Working/ Business Visa (Non Immigration Type: B) This type of visa will use to support the application for work permit and can be requested to stay in the Kingdom for one year. In case that an alien enters into Thailand under travel or in transit visa, he/she can not use such visa to apply for work permit. The visa that can be used to apply for work permit is Non-Immigrant visa which can be executed under the following ways :
      1. The company who wishes to employ an alien will have to prepare an employment letter including with supporting documents for an alien to submit to the Royal Thai Embassies or Royal Thai Consulates-General in their home countries. An alien will request for Non-Immigrant visa “B” in order to apply for work permit later. In case that he/she estimates that the work permit will be granted within 90 days, he/she may use to apply for single-entry visa or if later than 90 days, he/she must apply for multiple-entries visa.
      2. The company who wishes to employ an alien will have to prepare an employment letter including with supporting documents submitted to the Ministry of Labour and Social Welfare. When Ministry of Labour and Social Welfare has sent the letter of permission, the alien shall bring such letter including with other supporting documents submitted to the Royal Thai Embassies or Royal Thai Consulates-General in their home countries to apply for Non-Immigrant “B” visa and apply for work permit later. Such submission to the Royal Thai Embassies or Royal Thai Consulates-General must be made within 30 days from the date of receiving permission from the Ministry of Labour and Social Welfare.
    2. Education Visa ( Non Immigration Type: ED )
    3. Retirement Visa (Non Immigrant Visa Type O-A) This type of visa may be issued to applicants aged 50 years and over who wish to stay in Thailand. An application must present the bank statement showing a fixed or saving deposit of the amount equal to and not less than 800,000 Baht or an income certificate with a monthly income of not less than 65,000 Baht, or a deposit account plus a monthly income totaling not less than 800,000 Baht as the supporting documents for consideration. The applicant may submit the documents to apply for retirement visa at the Immigration Bureau and will be granted to stay in Thailand for the period not exceeding than 1 year.
    4. Marriage Visa ( Non Immigration Type: O )
    5. Dependent Visa ( Non Immigration Type: O )

    What is Non-immigrant Visa?

    Non-immigrant Visa O, Non-immigrant Visa B, Non-immigrant Visa ED
    For this type of visa, the foreigners must apply for a Non-Immigrant Visa at the Royal Thai Embassies or Royal Thai Consulates-General in their home countries by specifying the reasons of entry into Thailand in visa application form.

    The government has determined the objectives of entry into Thailand in English abbreviations for the foreigners to specify in the visa application form. Non-Immigrant Visa is very important because this is the only kind temporary visa that granted a work permit to the applicant. However, for the foreigners to be granted work permit, they shall follow the Alien Working Act B.E. 2521 section 11 which specifies as follows :

    “Section 11: An alien who may apply for a permit under Section 7 must possess the following qualifications:(1) having a place of residence in the Kingdom or having been permitted entry into the Kingdom for temporary stay under the law on immigration but not as tourist or in transit…”
    In order to be granted work permit, it is indicated that the alien must apply for visa which is not tourist or in transit visa. The alien who wish to apply for this type of visa must fill in visa application form by specifying the reasons of apply for the visa and submit to the Royal Thai Embassies or Royal Thai Consulates-General in their home countries. Since this type of visa is very important on that it can be used to support work permit request and permit the alien to stay in Thailand as long as needed, such visa will be issued as sticker attached to the passport. However, some Royal Thai Consular especially Royal Honorary Consular are still using seal. Such sticker or seal will contain the message indicated the type of visa and its code for example, if apply for working visa, the visa will indicate “NON IMMIGRANT VISA Class B”, if apply for study visa, the visa will indicate class ED or O means others. Such visa will indicate the duration of time to use visa until its expiration. This duration of time is usually misunderstood. It is understood that such indication is the duration permitted to stay in Thailand. Actually, the seal is permitted an alien to stay in Thailand for the period of 90 days even he/she has entered Thailand on the last day of the date specified on visa.
    In addition, even if there is the word “NO EXTENSION OF STAY” appeared on visa, an alien has entitled to apply for an extension according to his/her reason and necessity. If the authorized person considers that the reason or necessity is rational, he will permit such alien to temporarily stay in Thailand.
